Terms & Conditions and End User License Agreement

These Terms & Conditions and End User License Agreement (“Terms”) govern your use of thetechdragon.dev, Tech Dragon products and services, and any Tech Dragon WordPress plugin, installer, license screen, checkout, documentation page, or other product that links to these Terms.

1. Who we are

“Tech Dragon,” “we,” “us,” and “our” mean The Tech Dragon LTD, operator of this website and publisher of the Tech Dragon WordPress products and services described on it.

2. Acceptance and scope

By using this website, downloading, installing, activating, purchasing, renewing, or using a Tech Dragon product or service, you agree to these Terms. If you are using a product on behalf of a company or other organization, you represent that you are authorized to accept these Terms for that organization.

Product-specific terms, checkout terms, or open-source licenses may also apply. If a product-specific term expressly conflicts with these Terms, the product-specific term controls for that product. If an applicable open-source license conflicts with these Terms, the open-source license controls for the code or component it covers.

3. Website and service use

You may use our website, documentation, downloads, support resources, and other services for lawful purposes. You must not intentionally interfere with the operation or security of our website or services, attempt unauthorized access, abuse support systems, or use our services to violate applicable law or the rights of others.

4. Software license grant

Subject to these Terms and any applicable product or purchase terms, Tech Dragon grants you a limited, non-exclusive license to install and use the applicable software on the number and type of WordPress installations authorized by your license, subscription, purchase, or product edition.

Where a product is offered without a paid activation limit, you may use it according to the license distributed with that product. Where a paid license includes a defined number of activations, sites, domains, organizations, or other usage units, you may not exceed that limit without obtaining additional authorization.

5. Open-source software and WordPress licensing

Tech Dragon products may include code distributed under the GNU General Public License (GPL) or other open-source licenses. Nothing in these Terms limits rights granted to you under an applicable open-source license. The license notice distributed with a particular component governs that component.

Commercial license terms may still govern services and rights that are separate from open-source code rights, including license-key activation, entitlement to updates, support, hosted services, premium service access, download access, trademarks, branding, documentation, and other material not licensed under the applicable open-source license.

6. License keys and activation

If a product uses a license key or activation service, the key is provided for the licensed customer and permitted installations. You are responsible for keeping account and license credentials reasonably secure. You may not sell, publish, share, or distribute a license key for use outside the scope of the applicable purchase or license.

We may use technical measures reasonably necessary to administer activations, prevent obvious license abuse, and provide entitlement to updates or services. Information associated with licensing is handled as described in our Privacy Policy.

7. Free and paid editions

Some Tech Dragon products may be available in free, paid, or combined Free + Pro editions. Feature sets, support channels, update entitlements, activation limits, and included services may differ between editions. Current product pages and checkout information describe the edition being offered.

Unless a product page expressly states otherwise, purchasing a paid edition does not transfer ownership of the software, trademarks, or Tech Dragon intellectual property.

8. Updates, compatibility, and product changes

We may release fixes, security updates, compatibility changes, new features, or other revisions. WordPress, PHP, browsers, hosting platforms, themes, plugins, third-party APIs, and external services change over time, so perpetual compatibility with every environment cannot be guaranteed.

We may change or discontinue features or services when reasonably necessary for security, maintainability, compatibility, legal requirements, third-party changes, or product direction. Where practical, material changes affecting paid customers will be communicated through the product, website, release notes, email, or another appropriate channel.

9. Support

Support eligibility and response channels depend on the product and edition. Support does not include unlimited custom development, administration of third-party systems, recovery of unrelated site failures, or work outside the supported scope of the product unless separately agreed.

When requesting support, do not send passwords, private keys, API secrets, SMTP credentials, full license keys, payment-card data, or other unnecessary sensitive credentials.

10. Third-party products and services

Tech Dragon products may integrate with or depend on third-party software and services such as WordPress, Divi, WooCommerce, Cloudflare, MailPoet, Freemius, hosting providers, email-delivery services, or security services. Those third parties are independent from Tech Dragon and may change their products, APIs, terms, pricing, availability, or behavior.

We are not responsible for a third party’s service, outage, policy, security, or product changes. Your use of a third-party product or service is also subject to that provider’s terms.

11. Privacy, telemetry, and technical data

Our handling of personal information is described in our Privacy Policy. Certain products may transmit licensing, update, telemetry, compatibility, diagnostic, security, or support information when the product documentation or interface says they do so.

Where optional telemetry or diagnostic collection is provided, the applicable product should identify the nature and purpose of that collection. Do not intentionally submit secrets or credentials through telemetry, diagnostics, or support channels.

12. Your responsibilities

You are responsible for determining whether a product is appropriate for your environment and for maintaining reasonable operational safeguards. Before performing updates, cleanup, configuration changes, database operations, file operations, security changes, or other potentially consequential actions, maintain appropriate backups and recovery options.

You remain responsible for your WordPress site, hosting account, data, configuration, regulatory obligations, user access, and security posture. No Tech Dragon plugin should be treated as a substitute for backups, server security, access control, monitoring, professional judgment, or other controls appropriate to your environment.

13. Restrictions outside open-source rights

Except where an applicable open-source license or law gives you the right to do so, you may not:

• use paid services, hosted features, activation services, support entitlements, or license keys beyond the purchased scope;
• sell, rent, sublicense, publish, or transfer Tech Dragon license keys or customer-only service access to unauthorized parties;
• remove or misuse Tech Dragon trademarks, branding, copyright notices, or proprietary notices where those notices are not governed by an open-source right permitting removal;
• impersonate Tech Dragon or represent a modified or third-party product as an official Tech Dragon product; or
• circumvent technical controls for the purpose of obtaining paid services or entitlements without authorization.

14. Intellectual property and trademarks

Except for rights expressly granted under an applicable open-source license, Tech Dragon and its licensors retain all rights in Tech Dragon trademarks, logos, product names, website content, documentation, original artwork, hosted services, proprietary systems, and other protected material.

“The Tech Dragon,” Tech Dragon product names, associated logos, and related branding may not be used in a way that falsely suggests sponsorship, endorsement, authorship, or affiliation.

15. Feedback

If you voluntarily provide suggestions, ideas, or feedback about a Tech Dragon product, you grant us permission to use that feedback to improve our products and services without an obligation to compensate you, while you retain ownership of any intellectual property you already owned in the material you submitted.

16. Purchases, subscriptions, renewals, and refunds

Pricing, billing frequency, renewal terms, taxes, activation limits, and refund terms shown at checkout form part of your purchase terms. Paid transactions may be processed by a third-party commerce or licensing provider, such as Freemius, and may also be subject to that provider’s checkout and payment terms.

Where a subscription renews automatically, cancellation stops future renewal according to the applicable checkout or account terms; it does not normally undo a completed billing period unless a refund is required by law or provided under the applicable refund policy.

17. Warranty disclaimer

To the maximum extent permitted by applicable law, Tech Dragon software, websites, documentation, and services are provided on an “as is” and “as available” basis. We do not guarantee that software will be error-free, uninterrupted, compatible with every environment, or suitable for every particular purpose.

Nothing in these Terms excludes warranties, consumer rights, or other protections that cannot lawfully be excluded or limited.

18. Limitation of liability

To the maximum extent permitted by applicable law, The Tech Dragon LTD will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, goodwill, data, or anticipated savings arising from the use of or inability to use a Tech Dragon product or service.

Where liability cannot lawfully be excluded, our aggregate liability relating to a paid product or service will, to the extent permitted by law, be limited to the amount you paid Tech Dragon for that product or service during the twelve months preceding the event giving rise to the claim.

These limitations do not apply where applicable law prohibits them, including liability that cannot legally be limited or excluded.

19. Termination

You may stop using a product or service at any time. We may suspend or terminate paid-service access, support, hosted functionality, or license-key services if you materially breach these Terms, misuse the service, commit fraud, or use an entitlement beyond its authorized scope, subject to applicable law and any required notice.

Termination does not remove rights you hold under an applicable open-source license for code already lawfully received. Provisions that by their nature should survive termination—including ownership, disclaimers, limitations of liability, and accrued payment obligations—continue to apply.

20. Changes to these Terms

We may update these Terms as our products, services, business, or legal obligations change. The “Last updated” date identifies the current version. Material changes will apply prospectively as required by applicable law. Continued use after an updated version becomes effective constitutes acceptance where permitted by law.

21. Governing law and mandatory rights

These Terms are governed by the laws applicable to The Tech Dragon LTD in its place of establishment, without regard to conflict-of-law principles, except that consumers and other users retain any mandatory rights and protections that applicable law does not permit them to waive.

If a provision of these Terms is found unenforceable, the remaining provisions continue in effect to the extent legally permitted.
